Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BookItUSA website and booking platform (the “Platform”), operated by BOOKITUSA LLC (“BookItUSA”, “we”, “us”). By creating an account, submitting a booking request, or making a payment, you agree to these Terms. If you do not agree, please do not use the Platform.

1. What BookItUSA is

BookItUSA is a booking marketplace. We connect customers with independently owned and operated venues (“Venues”). We are not the owner or operator of the Venues, and we do not host, staff, supply, or control the events that take place at them.

Your booking creates a direct arrangement between you and the Venue. BookItUSA facilitates discovery, scheduling, and payment for that arrangement, and collects a service fee for doing so.

2. Eligibility and your account

• You must be at least 18 years old to create an account or make a booking.
• You are responsible for the accuracy of the information you provide, including your phone number and email address.
• You are responsible for all activity that occurs under your account.
• If we cannot reach you using the contact details you provided, your booking may be cancelled. Keeping those details current is your responsibility.

3. Bookings and confirmation

Submitting a booking request does not guarantee a reservation. A booking is only confirmed once it has been approved and the required deposit or full payment has been received.

Dates and times are not held until payment is received. If another customer completes payment for the same date and time before you do, your request may be declined and any payment you made will be refunded. Availability is allocated on a first-paid basis.

Guest counts, event durations, food selections, and other booking details may be subject to the Venue’s minimums, maximums, and operating hours as shown on the listing.

4. Prices, taxes, gratuity, and fees

• Prices shown on a listing are set by the Venue and are quoted per person unless stated otherwise.
• Where a Venue collects sales tax and/or gratuity, these are shown separately and are included in the total displayed before you confirm.
• Tax and gratuity are collected on behalf of the Venue and are passed to the Venue in full.
• A card processing fee is added to payments made by credit or debit card. This fee is shown separately at checkout. Payments made by bank transfer, where offered, do not carry this fee.
• All amounts are in United States dollars.

We aim to display all pricing accurately. In the event of an obvious pricing error, we reserve the right to correct it and to cancel and refund any affected booking.

5. Payment

Payments are processed by our payment provider. We do not store your full card details. Depending on the payment plan selected, you may pay in full, pay a deposit followed by a final balance, or split the cost among your guests.

Payment deadlines are binding. If a deposit or balance is not paid by its due date, your booking may be cancelled and the date released to other customers. Amounts already paid are handled under our Cancellation & Refund Policy.

Where a payment is made by bank transfer, funds may take several business days to clear. If a bank payment fails or is reversed, the amount will be treated as unpaid and you will be asked to pay again.

6. Changes and cancellations

Cancellations, refunds, changes to your booking, and cancellations made by a Venue or by BookItUSA are governed by our Cancellation & Refund Policy, which forms part of these Terms.

7. Your conduct at the Venue

Venues set their own rules of entry and conduct. You and your guests must comply with them, along with all applicable laws. In particular:

• Where a guest list is required, it must be accurate. Guests may be asked to present valid photo identification matching that list.
• Venues may refuse entry to, or remove, any person at their discretion, including for intoxication, unsafe or unlawful behaviour, or refusal to follow Venue rules.
• Where alcohol is served, all applicable age and service laws apply. Venues may refuse service at any time.
• You are responsible for the conduct of your guests and for any damage caused by them.

Refusal of entry or removal for breach of these rules does not entitle you to a refund.

8. Venues on the Platform

Venues are responsible for the accuracy of their listings, for the condition and safety of their premises, for holding all required licences and insurance, and for delivering the experience described. BookItUSA does not inspect, endorse, or guarantee any Venue.

9. Content you provide

You retain ownership of content you upload, such as guest lists, playlists, and reviews. By uploading it you grant us a limited licence to store and use it for the purpose of operating the Platform and delivering your booking.

You must not upload content that is unlawful, misleading, infringing, or that contains personal data you are not permitted to share. Reviews must reflect a genuine experience. We may remove or hide content that breaches these Terms.

10. Photography and video

Photography and video at Venues, including any use of images for marketing, are governed by our Photo & Video Policy, which forms part of these Terms.

11. Communications

By booking, you agree to receive service messages relating to your booking by text message and email. These include payment reminders, confirmations, and event updates, and are not promotional. Marketing messages are optional and require separate consent, which you may withdraw at any time. See our SMS Terms and Privacy Policy for details.

12. Prohibited use

• Do not attempt to access accounts, bookings, or data that do not belong to you.
• Do not attempt to disrupt, probe, overload, or reverse engineer the Platform.
• Do not use the Platform to arrange unlawful activity, or to circumvent a Venue's rules.
• Do not scrape, copy, or resell listings or Platform content without our written permission.

13. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose. We do not warrant that the Platform will be uninterrupted or error free.

We are not responsible for the acts or omissions of any Venue, including the cancellation, quality, safety, or legality of any event.

14. Limitation of liability

To the fullest extent permitted by law, BookItUSA will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Platform or from any event or Venue.

Our total aggregate liability arising out of or relating to a booking will not exceed the total amount of fees BookItUSA retained in connection with that booking.

15. Indemnity

You agree to indemnify and hold harmless BOOKITUSA LLC and its officers, employees, and agents from any claim, loss, or expense arising from your use of the Platform, your event, the conduct of your guests, or your breach of these Terms.

16. Suspension and termination

We may suspend or terminate your access to the Platform at any time if we believe you have breached these Terms, created risk or legal exposure, or engaged in fraudulent or abusive behaviour.

17. Changes to these Terms

We may update these Terms from time to time. The “last updated” date above reflects the most recent version. Material changes will be communicated where reasonably practicable. Continued use of the Platform after changes take effect constitutes acceptance.

18. Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. You agree that any dispute will be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction.
